| Greetings! My flat is illegally occupied by one employee of a co-operative bank. He also prepared forged property document and took a housing loan on this forged document. He has not only cheated me but also from same co-operative bank (employer). How can I initiate legal action against him? What are bodies / authorities where I can file a complaint against him (I have already filed a civil case against him) but I want to inform supreme authority in cooperative banks & RBI also. As per your version, the fellow who is an employee in co-op bank has created forged documents and raised funds from bank. Now the question is how he got into possession of your property of which you are expected to be in possession. Your main relief is criminal proceedings for cheating and creation of forged documents. There are several unfilled gaps in u r case. I do not know what is the nature of civil suit u have filed. If clear details are coming I can give further advice Quote:

Firstly, to prove the flat is your own you need to have proper documents of the said flat registered in your name in the Sub-Register office in your locality to prove in the court of law that you are the absolute owner of the said flat. Secondly, you need to obtain the alleged forged documents from the Sub-Register office to verify hiow your signature has beeen forged. Thirdly you need send the legal notice to the alleged forged party and the banker who has lent loan on the basis of alleged forged document and initiate your legal proceeding by filing a Orginal suit in both civil and migistrate court to restrain the parties concerned to do any further proceedings like selling of propery etc. Foruthly, you need give a news paper advertisement to make your facts public to ensure tha no third comes forward to buy the said property. Fifthly, you need put up a board with case No. specified on it, such that it becomes a warning for the public in general that unitl the case is disposed off the alleged owner cannot sell the property in dispute. Your terming an employee of a cooperative bank as "banker" is not correct. How the employee had access to your flat ? Whether you have rented out the flat to the employee of the coop bank ? If so how long ? whether you had entered into any agreement at that time? Whether the said flat is registered in your name ? and your are paying the property tax to the local body ? If the said coop bank employee taken possession of your flat by any illegal means, you have to proceed against him by resorting to criminal proceedings.
