Subject - Gratuity
Respected Sir,

I have worked with one reg. CA Firm (mumbai) for 9 years & on 31st mar 2011I gave resigned, but i have not asked him about my gratuity. (we had only 2 employees)

So, can i ask him now (3 month later) ?
Within how many days/month I can ask him about my gratuity ?

I am still working for him on 2 month contract basis. So am in touch with him.

kindly guide the same & oblige.

Subject - payment of gratuity
any person who completed 5 years service in a firm/company eligible for payment of gratuity in the event of termination of service or resignation/ closure of business. in that you are entitle for gratuity.

Dear Mr. Vinayak

Hope your firm is registered under Shops and Commercial Establishment Act.

Whether you ask or not, they have to give you Gratuity, Leave Pay (Whatever available in your credit) as you have resigned.

You can demand for your right.

Dear Vinayak,

POG Act applicable to the establishment where 10 or more employees engaged, once applicable it will be continued the strength fall down.

In your case, you are not applicable to get since two employees engaged.

you are not entitle to any gratuity, because the act does not apply to your organisation not being 10 employees.

You are not entitled to any gratuity as your organization is not covered under the said act, but the employer can decide as the law only specify the mandatory eligibility
