Can anybody be able to tell me whether an Employer is not issuing Salary Certificate, legal action can be launched against him or not. Is there any provision in LAW where SALARY CERITIFICATE is compulsory required to be issued on employee\'s request.

Yes, Employer shall issue the salary slip/certificate upon employee request. You may serve a show cause notice in case of failure asking for the reasons why the certificate could not be issued...

If they fail to answer the notice you may take further action.....

Dear Mr. BSSV

I am differing from your reply. Employer must give the Salary/Wages Slip to all their employees without fail. Here we need not to ask the employer to issue a salary slip. It is the responsibility of employer to issue the Salary / Wages Slip. If they fail to issue the same then as advised by you the employee can demand for the same and if the employer fails to reply/issue the salary slip, then the employee can proceed as advised by you.

the employers are required to issue the salary slips to their employees every month giving the details of the salary and deductions made for the information of employees as per the labour laws and practices. col janak raj vatsa
