Presently all four units, numbers of employee on contract are below 20 hence Contract Labour (R&A) Act, 1970 is not applicable. Henceforth we want to go for increase the limit of employee numbers up to 50. In view of above, Could you guide us the Legal suggestion / opinion for easier method for its applicability. s.kumarasubramanian - Member Since: Oct 2008 Subject - Re: Contract Labour (Regulation and Abolition) Act, 1970 Dear Siddesh, I am not clear about your No 50. Whether in every factory you are going to make it 50 or in all four units put together 50 Nos. Since you have obtained diiferent factory licence for all four units you can go upto 19 in each factory i.e. upto 76 in all four units. Regards, S.Kumarasubramanian Dear First of all be clear than licence is to be taken by the contractor if he is employing 20 or more workmen on any working day. You as a principle employer has to inform the authorities about the name of the contractor, nature of job and max no. of person to be employed by the contractor on any working day. You can engage more contractor and the each contractor should not have more than 17 persons on any working day. This will resolve your problem only thing you must send send the revised information mentioning the details of new contractors on the prescribed form under the Act ak malhotra rajanassociates Full Member - Member Since: Oct 2008 Subject - Re: Contract Labour (Regulation and Abolition) Act, 1970 Dear In this case you are the Principal Employer .If the qualifaction provision is attracted you require registration as principal employer.Best make an informal check with your authority and decide. Dear All, I have a question, If my company employs contract labours through three contractors, suppose each contractor employ 19 labours, 1) As a principle employer should we register under Contract Labour ( Regulation and Abolition) act ? 2) Do the contractors need to get licence ?
