| Hi all, I am working in one of the reputed software company in South India. I joined this company an year ago. Wherein, while joining i was put on a contract for a period of 18 months. They also got all my original educational certificates. The clauses in the contract said i need to work in here for a period of 18 months after which i am free to work with any employer. It also mentioned that i need to serve a notice period of 2 months. Now i am on my completion of 1 yr and 4 months in which i contacted my HR team saying that am putting on my papers. They blindly said that i need to complete the contract period of 18 months and then serve a 2 months notice period. They also threatened me saying that they wont give back the certificates neither a good feedback for BG check. Since i work for night shifts am planning for a change due to severe health problems. Now my queries are, 1. The clause in the contract says that after 18 months of time they will return back all the original certificates which i gave them. In that case,if i leave the company after 18 months of time am i eligible to get back my assets. 2. Since the clause of 20 months inclusive of notice period was not clearly mentioned in the contract how do i put forth this issue to my HR and get relieved smoothly after 18 months. 3. I clearly told my lead that i am looking for a change due to health reasons and gave the notice on the 16th months which also serves the notice period. In the last minute they say its not acceptable. 4. This being the case, please suggest me to get back my original certificates along with a smooth relieving order. 5. Note: Even after transparently discussing on the health problems, They are more concerned on the productivity rather than personal health. Please suggest.
