I have a query on maternity benifit,
1.If woman is not covered under ESI act what will be the eligiblity criteria for availing Maternity benifit act.
2.Kindly specify whether she is entitled for maternity leave as per maternity benifit act if is she works for 80 days in any organisation.

Dear friend,
For those who are not covered under ESI due to their salary limit we have to pay minimum 84days salary i n the compensation of their maternity leave.

Maternity Benefit Act will be very much applicble.
If the women has worked for more than 80 days in the organisation, she will be entitled to the maternity benefit under the Ac, even if getting more than Rs 10000/- pm.

if someone is not covered under ESI than maternity benifit act 1961 will be applicable to her.
as per maternity benifit act if a women worker has worked more than 80 days in last one year she is entitle 6 weeks maternity leave with pay.
