| PL help me.. Actually one of my friend is working in a company for last 08 years. He has a very good relations with his Boss. But now due to very old age Boss does not turn up to office & instead his son who is just 26 come's & handle's the entire business. Boss's son is very short tempered & he mentally harresses all the employees many a times he has also injured some of the employees physically. Now my friend wants to leave the company but ne boss thretan's him saying that he will file a fraud case against him. My friend had signed on a blank paper which had revenue stamp on it last year as well as yesterday. He was told that this sign was to confirm the receipt of Diwali Bonus.(Each employee had signed on it ) My friend thinks that his boss will use this paper & write any thing boss wishes to prove him a culprit. Plz help me & let me know what misuse can his new Boss do with the signed blank paper with revenue stamp. Moreover my friend has not mentioned the date below his signature. Also pl let me know all the legal aspects.. What his new boss can do?? & How can my friend escape form this dirty politics. My friends new Boss does'nt even allow him to resign & harresses him mentally. My friend is so frusted that he thinks of commiting sucide; He is such a dilemma that he can neither quit the job nor can he work properly & the worst his family is totally disturbed. Also pl let me know how can he resign? If he resigns without notice will there be any problem?? Is there any legal procedure to Comeout of this?? Dear Friend Ur friend may any time give resignation as per the terms stated out in the appointment letter or he may resign straight way, there is no such big issue if he dont want any relieving letter from the existing company. The question that signing blank document may put ur friend in trouble is quite filmsy, the black mailing of such type may takes place and look good only in bollywood movies and not in real life. ur friend may deny the signatures and may put his boss in troulbe by coercing him to sign on blank papers. Regards I would advised you to file a criminal complaint against your boss in police station that he has taken your sign on the blank papers otherwise he can use that papers to prove anything against you in court..like he may file a recovery case or he may write like you have mortgage your property to the company or simply create a bond on that paper and its not filmy...it happens...i know my one of client has signed a blank paper for the HRA clearance and later he was sacked and a case for recovery was filed by the company against him... Take help of other collegues who want to leave the company with you and prepare a joint application and file before concerned police station. it will help you at the time of contesting the case...court normally ask why didn't you file the complaint against the person... So file the complaint and leave the company or otherwise appoint a lawyer who can prepare the complaint for yourself... Dear Shyam, I also have the opinion that if your friend has finally made up his mind to leave the company then in that case he must firstly send appropriate legal notice through an advocate to the employer stating therein regarding getting the signatures on the blank document and calling therein for: 1. the return of blank documents to you within 5 days time from the receipt of notice. 2. statement of accounts and dues accruing in your favour or against in the company as on date. (this will facilitate you in bringing on record the real state of affairs and you would know if at all any of the blank papers signed by you are being used by the employer because after giving the statement of account the employer would not be able to make alterations or additions. If the employer does not give the statement of account even after the receipt of notice this would draw adverse inference against him). If, even after the receipt of the legal notice, the matter is not being sorted out then you may opt for filing criminal complaint in the court of Magistrate having competent jurisdiction. Please note that if any of the blank document given would be used by the employer then after your getting knowledge of it, a complaint for forgery of documents may be filed and in that complaint itself your friend also can harass/get punished the director(s) as well as the concerned persons by arraying them as accused in the criminal complaint for forgery. Don't be anxious, ask your friend to have patience and faith on justice. Regards, Ram Gautam 8-) your friend should send legal notice/ pre notice as per terms and conditations of appointment letter through a lawyer stating and demanding to return you that signedblank paper if he don't return the paper take the reply of the noticie and file a complaint against him for mentaly harassment and cheating as far as misuse of balnak paer is concerned he may use this paer for recovery of loan and nothing more if he will use this paper for recovery of loan then he will not have any more proof to proeve that you have taken the loan from him.
