Hello!

Can employee sue employer for not giving bonus as employee resigned before bonus and the salary of that employee is more then 10000/ and not entitled under bonus Act. Employer is denying to give bonus saying that you have resigned and there is no policy. what are the legal provisions and how to claim bonus.

If his basic was > 10000/- then as per law he was not entitle.
And you can't do anything.

mr Yadav is correct .your basic was more than 10000 than you are not entitle for bonus and your employer is correct.

Dear All,

I just wanted to know what is the remedy available legally to an employee in the below cases.

1. A resigned employees whose salary is >10,000/- but his bonus is included in his CTC statement signed by the employer, does not receive his bonus.

2. If the resigned employee whose salary is >10,000/- & his 20 % bonus is included in his CTC, but is paid only 8.33 % bonus since he left.

Experts pls advise.

dear
this is unfair practice and u can not claim under bonus head.you can not file case under bonus act as your basic is more than 10000.you talk to employer because it is part of ctc.
