ESI compliance

Subject - ESI compliance
Hello ,

Can you pl. clarify this question.

A 100% EOU SW company with STPI Registration, with 30 employees below 10,000 p.m salary, having a individual medical insurance policy of Rs. 50,000 p.a, Is it compulsory to register for ESI , or as the compnay has already provided Medical insurance, can we escape from ESI registration.

no, you can not escape from ESI registration.you please take ESi code as early as possible otherwise you have to pay penality from the day you were having 20 employee.
mediclaim just give medical facility whereaas ESI gives so many other facility and medical insurance is not alternate of ESI legally.

you have to take ESI coverage . it is hardly matter you are providing the medical benefit. actually as per the act if your medical benefit is more beneficial than ESI. you should apply for ESI exemption. the ESI official will inspect & compare the both. then they will exempt you for coverage , although it will valid for 1 yrs only .

can you pls tell us where this provision of ESI exemption is given in act and as you have mentioned it is valid for one year.please provide SECTION of ESI act .

My self is Ravi i am working in Construction company just i want to know full deatils about ESI Compliance.the Hr Department in company was setup in the month of Jan 2008.in this organisation things are unorganised ,so kindly suggest me how to handle such condition, and i am the only person handling 60 emply, so kindly suugest me for the same
