Subject - Regarding Will
Hi,
My father died 3 years ago. He has wrote will some 25 years back. But he has kept it somewhere and lost it. Where can I get copy of the will if it is registered. If not means, How can I share the property(house) with my brother. We want the property get divided between us.
Can I get loan from that property which is in my fathers name?. please help

Dear Friend

It is not necessary to get the Will registered.
If the will is untraceable than the property may get devolve as per Hindu Succession Act or as per the personal law applicable to u.
U may get the loan on your property and not on the property of your father.
Hope this may clarify ur doubts

Dear friend,

If the will is registered in registration dept and you have Registered Document number then you can apply for copy of the will by filing copy application attached with you father's death certificate.

If you have no Registered Document number and you know the year & month of registration of Will then you can search and find the document number and then apply for copy application.

If you are not able to get copy of will, then the property will devolve under succession. If you are a Hindu, then the property will be equally shared by mother, sons and daughters.
