hello friends,

i am new member of this site . i am doing LLM from M.S.University, Baroda. friends i need your guidence regarding a topic of clonning. Clonning is patentable or not in relation of IPR? if possible pls guide me as soon as possible as this is a topic of my presentation. from where i can get details of this topic as this is new concept, i have also refferd a book of Wadhera but i could not find enough material from this book and also from net. pls help me friends.

The question is really very tricky and debatable but still i would like to try it out

My Argument on granting the patent-----

I would like to fetch ur kind attention on the applicability, object and the meaning of Invention under Patent Act,

Invention means any new and useful art, process, method or manner of manufacture, machine, apparatus or other article, substance produced by manufacture and includes any new and useful improvement of any of them, and alleged invention

Therefore, an invention is the creation of intellect applied to capital and labour, to produce something new and useful. Such creation becomes the exclusive property of the inventor on grant of patent.

The literal definition if we apply on clonning then the process of cloning can be patented

on the other hand my argument on not granting patent on cloning is -----

The invention which is contrary to natural law, contrary to public law and moraility, on such inventions patent should not be granted.

So granting patent on the process of cloning is quite religious and moral issue, the answer of the same may be lies in future.

Thanks for your reply , really you have given me correct guidance on clonning. can you give more details of this as clonning can be done on agriculture, plants, animals, and human being can you suggest me more on this topic ?
