A employee, who has completed 5years in service, can claim gratuity during his service or it will be at the time of leaving the organisation.

Employer is liable to pay gratuity to those who are eligble even in the time of cose down or lock out or Bankcrupt,

Dear,
Regarding gratuity payable at the time of bankruptcy, the company has to pay gratuity as per the clauses of settling the issues as per insolvency. According to insolvency petitions, all the statutory payments like taxes and others payable to government or as per government rules, it has to pay.
There it will be paid even in the time of bankruptcy.
