I am working in a private limited company and we are in a phase of formulating new policies for the employees. I need guidance over the lunch hours of the employees. We work in a shift from 9:00 am to 5:30 pm for 6 days of week in general shift for the staff members. The lunch time is 30 minutes. If I calculate the working hours inclusive of lunch time then for a week it becomes 51 hours. Whereas it is mentioned in Factories Act that the working hours shall be 48 hours.
So I have a questione "Whether Lunch Time is included in the office hours or not"? is there any such judgement or law supporting the answer?

lunch hours should not be included in working hours.it is the time for lunch and individual has not worked during this period.even you can give lunch for one hour also but that will be excluded from working hours.
as you have calculated for weekly hours ,it is working hours 48 not total hours.
