| Hi All I have a computerized attendance system, recently a Labour Inspector has visited a factory and he has asked that the Mangnt should take a approval for maintaing the comperterized attendacne or Wage register, salary slip, leave card, bonus. Further we have been depositing the salary & wages of the employees inthe bank the inspector says that too we have to take approval from labout office or employees has to give NOC to it. What is right procedure ? if you have any format regards the application for applying to Labour Office above both than pl. send. it. Thank Raj dear if u are covered under factories act than chief inspector or director factories will give u permission for maintaing computerised record and u will attach all formats with application . if you are covered under shop and establishment act than labour commissioner or any seprate authority designated in your state will give u appproval. regarding opening of bank account u design a format and take noc from employees to open a bank account,no other noc required from any authority.. tks j s malik 9810557181 jitendersyadav Full Member - Member Since: Sep 2008 Subject - Re: approval of Computerized attendance Dear, As per my knowledge neither you required Attendance NOC nor Bank transfer NOC from Labour Deptt. If you are maintaing the computrised attendace > just take a printout of the attendance & paste it on mustar roll that would be suffice. For Salary Transfer in bank > You just take a written request from employee to credite the salary in their account & file this letter in their personal file. After that no one will challange your statutory. Rgds/Jitender Dear All, I am working in Tamil Nadu state, is computerized attendance allowed in here as in Karnatake, in there they use Form T for attendance, in which all the information about the employee would be found. Regards, Sriram V B Dear All, The legal position in this reagrd is Various labour laws prescribe attaendance to be maintained and prescribe Formats for the sanme. Further Information Technology ACt, 2000 in Sec 4 of it has an overriding affect over all the existing Laws and assigns authenticity to every document maintyained in electronic form. So the coprollary is Documents / Registers / Records which can be maintained in physical form can be maintained in electronic form as well, the only thing is that The prescribed formats can not be avoided as IT Act does not override the existing provisions in this respect. But the practical problem is how to make understand laobour authorities whose role has gone redundant and are just playing hindering role.
