| Dear All, MY Friend was terminated with immediate effect on the ground there was mismatch of period of employment of 2 months with his previous employer. He accepted the letter and claimed for the dues pending with the company for his travel ,Hotel stay claim,and notice period salary claim(which was mentioned in his contract of service) The company refused to pay the notice period pay stating that as per updated employee rules he is not entitled to get notice period which was not even informed to the employee Moreover he had been asked to contact his reporting Authority for rest claims. Pls confirm whether he can move to the court for the Breach of contract and for claims pending with the company Regards dear mostly this clause is also given in appointment letter that if you conealed the facts your services can be terminated without notice. your friends have concealed the facts if present employer take it seriously, than he can take action which is justified. dear if he comes in the category of workmen than he can take help of payment of wages authority ,if he is not in workmen category than no use of going to civil court which very lengthy process and your point is also not so strong. tks j s malk
