Enchashment of Leaves/Lapses of Leaves

Subject - Enchashment of Leaves/Lapses of Leaves
hI,

Our Company is established under Bombay Shops & Establishment Act,

This is the first time we are drafting Leave Policy for our company.

Which consists of 21 PL, 3 CL, 3 SL,

Out of which 10 leaves will be enchased and upto 42 leaves will be accumulated as per law.

Leave policy will be effective from 1st April 2009-31st March 2010

Now the question is that we have employees working in our organisation for more than 5 years whose leaves has been accumulated for more than 60 days. I would like to know can we lapse the leaves for more than 42 days or we have to compensate those leaves by paying them salary against accumulated leaves.

dear
leave policy u have formulated is alright as per bombay shop and est act.please check your act because leaves are given and counted as per calender year not as financial year as you have proposed.
dear as u have asked about lapses of leaves who has put up more than five years of service ,you can do so but ethically it is worng as you have never conveyed them regarding this and they may be hopping that they will get encashment when they will leave the service.
