| An employee is entitled for payment of Gratuity under the Payment of Grauty Act,1972 only on completion of five continuous years of service failing which the same is not payable. As regards the question of contribution by the Employer of package, it is a misconception since under Sec.4A of Payment of Gratuity Act, 1972, Compulsory Insurance is mandatory for a Employer for payment towards gratuity under the provisions of the Act with the presribed insurer.
