Subject - Payment of Gratuity
Greetings,
Can it be right of the employee to ask for the 'Payment of Gratuity' on quiting the job before Five years, I am asking specifically in case where contribution to gratuity is considered in the package.

you are not entitle for gratutity before five years of service,let it be a part of your package.

An employee is entitled for payment of Gratuity under the Payment of Grauty Act,1972 only on completion of five continuous years of service failing which the same is not payable.
As regards the question of contribution by the Employer of package, it is a misconception since under Sec.4A of Payment of Gratuity Act, 1972, Compulsory Insurance is mandatory for a Employer for payment towards gratuity under the provisions of the Act with the presribed insurer.
