| I'm working in a manufacturing company and we are having permanent nature of work. We have some security posts with in premises and have regular manpower but same on contract through security agency. In one reply Mr. Malik said that company can not go with contract labour for permanent nature of work, now I'm confused that is it legal to hire security on contract for security (vigilance and other) on regular basic without having any change in nature of work and security manpower. regards Dear Mr.MK Ravi, There is no prohibition of engaging security personnel through Security Agencies, in addition to your own regular workforce. Outsourcing security services is the most accepted and prevalant practice in indusries and establishments. While you have got the liberty stated above, pl. ensure the following; 1. Such Security Agency is duly registered with EPF and ESIC and also regularly complying with the provisions of bothe the laws. It is not advisable to engage small-time agencies who are not registered as stated above and are not regulary complying as otherwise, as Principal Employer, your Company will be held responsible not only for the employers as well as emplyees contribution but also the attendant legal consequences. 2.
