Subject - negotiable instruments act-blank cheque
Dear All,

can any one tell me the exact legal possition in a case wherein ,

a signed cheque without writing the date and amount is given to a company in advance

for the purpose of filling the same with an amount equal to the amout of goods that

will be supplied on future date. If that cheque is bounced ,whether that will come under sectio 138 NI Act ?.

Is there any illegality in receivng such signed cheques in adavnce?

Is it necessary that the company should obtain his consent before writng the amount and date?.

Is it also necessary to intimate him before presenting the cheque?
