| Dear Friends, My Village Court has ordered Rs. 1000 maintenance and after one year my husband is not giving me regular maintenance due amount ordered ealrier by Court. I am unemployed and no any way to survive. My court megistrate says "there is no any law for bind your husband to give u ragular monthly maintenance". He is very irregular to pay Rs 1000 a month and i cant survive in this world. court is not helping me to provide monthly maintenance. wht should i do!!! In this respect i want to bring in your kind notice that if you are the legal wife of your husband and not gotten the divorce from your husband then you are fully entitled to get the monthly maintenance for your survivals. if you have the order copy of this case having the statement of the court that there is no any law for bind your husband to give u regular monthly maintenance and you are the legal wife and not gotten the divorce from your husband then you can send me the copy of the order passed by your court and then after review your case we can go in higher court to appeal against this court and you shall get the regular maintenance from your husband. you can apply your case in MS. KIRAN BEDI Court programmed on Star Plus only if your case in court has been finalize For your querry it seems that your husband is paying you maintenance and he is only irregular in paying you the maintenance. Please read the order of the Magistrate allowying maintenance u/s 125 of CrPC. If the Order clearly says maintenance of Rs 1,000/- per month in letter and spirit the amount of Rs 1,000/- should be paid to you regularly every month. you can initiate contemp proceedings against your husband for non compliance of court orders.
