Dear Friends,

My organisation is an autonomous body linked with Government. Earlier we have engaged candidates on contract basis. Later based on the qualifications some of them who are having eligibility have taken on regular basis. one of the candidate who is not having requisite qualification candidature was not taken into consideration. He approached Industrial Tribunal and got favourable orders. We approached the Hon'ble High Court against the orders of Tribunal. The High Court directed that "There shall be interim suspension of the award in ID, subject to the condition the petitioner complying with Section 17-B of I.D.Act. From that onwards certain amount is paid till feb, 2009. The remuneration was stopped from march 2009 onwards since he has completed 58 years of age. As per our norms, retirement age is 58 only. Accordingly, amount is not paid. Now he is demanding to pay the amount. The Court case is still pending .
My request is what action to be taken at present. Whether we have to approach to Court again. It is learnt that the candidate has made a WP in the High Court. The amount is to be paid or not. Is there any precedent cases are available.

KINDLY SUGGEST ME. MATTER IS URGENT.

Don't pay him anything rightnow, just wait till court decision/order.
