Subject - witnesses in criminal complaint filed by corporates
Sir,

I am Manager Legal in a reputed concern having branches across the country. In the criminal complaints filed by our concern either through police or court (private complaint), the said complaints are lodged by branch heads. Later when these people leave the concern, they refuse to come & give evidence. Please let me know about any other alternative to proceed the criminal cases in the absence of the person who signed the complaint.

one person who has filed the criminal complaint on behalf of the concern has not compulsory to come in court on that particular date because when he puts the sign on the complaint in the capacity of company's representative of the company, and when the representative has changed then the holder of that seat will be the same capacity after taking the permission of the court but if they are listed in evidence, then the person who has signed the complaint shall be compulsory to attend the court on the particular date, if they are refusing then a summon can be obtained from the court to appear by the next attorney of the case.
