Hi all,

Is it really required to make flat agreement for rent by giving brokerage to broker, can i and owner make the agreement, what the law says?

Please reply soon.

I am staying in thane, mumbai and waiting for renewal of flat agreement and I want not to give brokerage instead make agreement with owner directly as we two are agree on this, but broker has come one day and was asking for giving brokerage for new agreement.

As written in previous agreement tanent(licencee) may or may not go for brokerage depends on owner and licensee.

The Rent or lease agreement is necessary in law for both the parties and it is very useful to all, in our country law, there is two type of agreement one is as formal rent agreement which can be typed on the Rs. 50/- non judicial stamp paper and it can be valid for upto Rs. 3000/- per month rent and security up to Rs. 6000/- and valid for 11 months duly affixed with photo of the landlord and tenant.
second one is typed on E stamping with value of 2% of the total average rent per year duly registered with related registrar by a advocate with photo of the landlord and tenant and valid upto the any numbers of the years and Rs. 100/- will be extra paid for the security amount which can be any of amount.

the brokerage shall be payable only one time when you take or give the property, there is no option to pay on the rent renewal or renewal of agreement because brokerage shall be paid for the first time meeting of both of the parties, therefore you should not pay the brokerage if you are going to renewal of agreement.
