| I worked as a Sr.Executive Talent acquisiton in a leading Broking house with pan India presence for 1 yr.Recently I resigned wherein I was unable to serve the notice period of 3 months for which I was willing to pay but my employer was not keen on taking the n/p money but instead they wanted me to serve the N/P of 3 months,which was not possible since i got a new offer and my current employer was not willing to wait for me that long.I wrote a mail and explained the entire senario but to vain.So after 10 days of serving my resignation I wrote a final mail regarding my conclusion from my services & I left.Now they have send me a Termination letter reasoning abscondence,misconduct & indiscipline.They also called up my current employer and tried to jeopardise my image. Kindly suggest the legal course of action and jurisdiction of the case since in the offer letter it was mentioned any litigation will be settled in mumbai jurisdiction and I have reloacted to Jharkhand Hi, Let us know about your appointment letter/ Service Agreement and Its provisions for Termination / Notice period. If it allows Notice period can be compensated with amount. You can send a notice for defamation. But,before going to legal action try to explain situation to current employer and send a detailed and strong replay to the old employer and cc to new employer. Regards Ramesh Dear Mr.Bubai, If the terms of appointment is 3 months notice or in lieu thereof notice pay , you could have deposited 3 months pay along with your notice of resignation. The best way is even as a remedial measure, you may settle the notice pay amount to avoid legal hassles from your previous employer, more so because the dispute jurisdiction is Mumbai.
