| DEAR As per minimum wages act definition of minimum wages includes HRA where as provident fund is to be deducted on minimum wages as per the latest instructions of provident fund dept.i heard there was a judgement from supreme court in this regard. if anyone have copy of the judgement ,pls forward the same. tks j s malik Dear There is no SC Judgement. It is the instructions from one of the office of PF commissioner. First of all you go thr the definition of minimum wages under the Minmum Wages Rules of the state; whether it is basic wage or say inclusive of HRA. Each state have different definition. Yes PF is not agreeing to this and asks employer to pay contribution on total amount of minium wages inclusive of HRA, but employer association of Karnatka have filed a writ in the HC that once Act says it is inclusive of HRA than PF not to be deducted on minimum wage and HRA to be excluded.
