Subject - can we appoint off role peoples

Dear sir
We are X ltd company based on Gujarat. branch has been opened in Tamilnadu.we have appointed some ITI persons for production by giving monthly cheque . They are now temporary only. Can we proceed like this. oherwise we have to cover them any PF act or ESI act.
