Dear Vermaji,

As per Section-27 General Clause Act which reads as under:-

"27. Meaning of service by post. - Where any Central Act or Regulation made after the commencement of this Act authorizes or requires any document to be served by post, whether the expression "serve" or either of the expressions "give" or "send" or any other expression is used, then, unless a different intention appears, the service shall be deemed to be effected by properly addressing, pre- paying and posting by registered post, a letter containing the document, and, unless the contrary is proved, to have been effected at the time at which the letter would be delivered in the ordinary course of post".

Further HC & SC had made it clear that refusal to take Notice is a Delivery.

Hope I have clarified your doubts.

Dear Mr. Shaikji, thank u very much for your reply.

I could not able to understand your message as it is written in Legal vocabulary, but the conclusion which u have stated at the end telling "refusal of notice is Delivery" i understood very well but my doubt is not cleared that if i refuse to accept the notice from postmen telling that the particular person to whom it is addressed doesnt stay here and he has shifted to some other place then what action the advocate can take will he send the notice again to the same address or wii it be considered as DELIVERD.
consider that the advocated who is sending the notice stays in another city.

Looking forward to your reply,

BR,
