Hi All,

I joined a MNC in June 2008 and after one and half year my reporting changed to new manager, it was very much difficult to work with him. I had to put my papers and as per the company internal policy an employee have to service notice period of 45 days or salary/damage in lieu of notice period but unfortunately I could not do that, I could serve notice period for about 27 days and after serving 20 days notice my manager locked my computer in between the notice period so I could not mark my attendance in the system, I went to HR and disclosed this but not putted any written complaint and HR informed me if you leave without your exit interview you would be treated as absconded. I have following questions:

- Can employee be treated as abscond if he/she could not complete his notice period, what are the assumptions? how does courts/rules protects us?
- What is the role of HR if a manager is embarrassing a employee.
- Resignation and/or Exit interview should be taken care by HR not reporting Manager? Am I right if yes how can i proceed in court with that if I have to?
- Should HR take action against him by asking how an employee could not mark his attendance after resignation. What the manager was doing than?
- Can HR be liable for this in local courts.
- Can employer stop my PF money? this is important ! if yes what rules protects us?
- If reporting manager has resigned, who else would take care of my case ?
- If I have to suite a petition in court can I do against reporting manager other than HR?
- Can I serve my notice period now, can I compel them to make this happen? If they say no can I go to the courts against them?
- what does this mean 45 days notice period or salary in lieu of notice period, does this help?
