I have posted complaint on consumer forum against XXX Pvt. Ltd. I have got legal notice from company to pay fine of Rs. 50000/- & 3 yrs imprisonment, complaint was regarding fraudulence with employees such as not to pay salary on time(1-2months), (PF, ESIC, PT)returns & many more. Have I did anything wrong. Plz suggest some way out. I am in trouble.

Your querry is not clear. Who has lodged complaint against whom?
First you are telling that you have filed a complaint in consumer forum against Netwing Technology.
Second you are telling that some company has asked you to pay fine and 3 years imprisonment. Is the company have any right to give some verdict against anyone for any imprisonment?
What they meant to convey with the letter regarding the payment and PF, ESI and PT Returns.
Can you post your querry clearly.

I have posted complaint against my previous company i.e. XXX Pvt Ltd. I worked there from June 2011 to January 2012. I have issued complaints on consumer complaint forum which include 6 to 7 points. below mentioned are complaints issued:

1. Salary not on time. (duration can be 1 to 5 months)

2. They deduct PF from monthly salary but I have not received PF amount yet.

3. ESIC login authorization failed.

4. Not sure whether company pays ESIC, EPF challans, PT.

5. Company deducts 1month salary & also not provides relieving if notice period not served.

6. Some ex- employees have got only 60% to 70% of actual F & F amount.

7. Company has recruited or in process to recruit new employees saying we are recruiting for project of Govt. of India. but actually it is not.

8. Director has money to buy BMW, fortuner, list of cars, property but he doesn't have money to give salary to employees.



Because of this complaints, company has sent legal notice against me for uploading above defamatory contents, but actually my intention was not bad at all, Even my colleagues have faced same problem. I don't wanted anyone like me to suffer same problem that was the only concern.

Please suggest any way to overcome this situation.

You may have editing option through which you may just delete the name of the company.

And regarding your complaint, please clear me these :
1) you are the one who has first filed a complaint against the company, right??
2) later, your company has served a legal notice stating that if you do not take back your complaint you will be subjected to the fine and may be for imprisonment, right??

And, nothing to worry about that, you have not done anything wrong...

you, go to the consumer Office where you have filed a complaint and tell them that you have got the notice, and ask them that they are trying to threaten you, and what should you do?....... and request them to reply to that notice from the office and take some immediate action.....otherwise these kind of behavior of the company may result in employee exploitation...

And its a criminal case, once you file a complaint it is the duty of the concerned authority to take the further action, make sure that you have the valid proof as to the subject matter of the complaint...

Those kind of notices are common by such companies in order to restrain the employee move ahead and claim their legal rights..... be strong enough to withstand.....

As per my opinion Consumer form not a proper stand for your complaint . it is one type of Labor court matter. and HR related issue.

Dear My advice for you that Equity will always decline relief in cases in which both parties have schemed to circumvent the law.

How could consumer forum accepted your complaint as your complaint comes under the purview of Labour Court. And to restrain employees or consumers , companies do threat them with legal & penal action. You need not worry. Just approach the concerned Labour Officer of your area in which your company falls under and show them the legal notice and leave the rest to them. No need to worry if no wrong had been done by you.
