Hi, I am employee of TCS KPO. I got an offer with high salary, to join after 90 days as I had 90 days notice period. So, I resigned that day itself. Now, next company is asking me to buyout notice period of one month and TCS is not ready to do so. What can I do? Is there any law I can use to negotiate with TCS?
In My offer letter, it is written:
"During your employment with TCSL either you or TCSL can terminate the appointment by giving 90 days written notice or 90 days gross salary in lieu thereof. However, TCSL reserves the right, if it is in interest of the business and current assignment, to decide on the option of completing the notice period or adjusting the same with the gross salary in lieu of the notice period.\"

Please go and negotiate with your immediate Boss and HR Department, because these two only can help in this matter. Here in your offer letter they have already obtained your acceptance signature about the decision of buy back option of notice period and the company has the complete right to deny also. Please approach them with cool mind and your politeness will surely fetch fruitful result.
