hello all experts I have seen forged documents in legal battle. how can it be proved. what is the punishment in india.

Thanq for replying.but as civil matter it will kill years of time in turn original party feel harassed.can we not file criminal proceedings.

Hi. YOu can always file a Police complaint. But even in Criminal proceedings, you would have to prove the forgery in the court.

If you have original documents or some proof that the documents produced are forged and documents belongs to you , then you can lodge a complaint under section 363, 364 of Indian Penal code.

Hello everybody
thankyou for participation.actual story is culprit himself has filed a case in civil court with forged signatures in documents claiming ownership of land. Now is it not harrassment to prove originality.if proved guilty what is punishment & how much time it will take.

You may produce your own original registered sales deed to prove his document as fake, or ask him to produce his original registered sales deed.

Are you in possession or other party is in possession? Because possession plays a vital role in civil case as possession holder has more chances to win and he is not a looser as he is enjoying the property. in both the situation file the written statement in the court.

Thanks alot for participation and valuable suggestions.The said property is in our possession but he is claiming in court that it is in his possession.what is legal meaning of possession.please highlight.

Once you are having the possession of the property, the chances of winning the case is bright in your favour. You must keep the mother document and other original documents also in your possession. Do not hand over the same to others even for xerox. You can produce the same in the court of law to prove yourself not guilty.
