We are planning to engage engineers / officers in supervisory, operational as well as - in some cases - in managerial functions at various construction sites across the country through Temping agencies. I would like to know whether License under Contract Labour (R&A) Act 1970 would be required for engaging such officers / engineers at Sites, if more than 20 of them are engaged in each Site?

The contract labour regulation and abolition act is applicable to every establishment in which twenty or more workmen are employed or were employed on anjy day in the preceding 12 months as contract labour; workmen is defined any person employed in or in connection with the work of any establishment to do any skilled, semi skilled or unskilled manual, supervisory , technical or clerical work for hire or reward whether the terms of employment are express or implied but does not include : a)who is employed in managerial or admninistrative capacity or b) who being employed in a supervisory capacity draws wages exceeding five hundred rupees per mensem or exercises, either by nature of the duties attached to the office or by reason of powers vested in him, functions mainly of managerial nature.......
Therefore if the strength of supervisors in any of the establishment exceeds 20 then only the contract labour act(R&A) will be applicable.
