I have joined in June 2012 and got my appointment letter in Aug 2012 In Appointment leter it was mentioned to serve a notice period of 2 months or else 2 month salary to be given in lieu of notice But i have not signed the copy of appointment letter I want to resign now Can company put a legal case AGAINST ME?

What was given in your Offer of Employment letter issued to you before joining?
Now you can submit your resignation letter stating that the appointment letter is insisting me to serve 2 months notice for which you are not ready to accept and which is not available in your offer of employment letter. Hence you submit your resignation letter.

You can put down the paper as the agreements become valid once you put your signature. And if they have not mentioned regarding this clause at the time of joining you have full right to resign.
I have received only the word document stating that \"we are pleased to offer you the position of in
our organization on the terms and conditions discussed during
the interview\" But nothing was discussed at the time of interview. As i had a telephonic interview.
And in Appointment letter it is mentioned \"Please confirm that the above terms & conditions are acceptable to you and that you accept the appointmnet by signing a copy of this letter of appointmnet\"
Now can i put my resignation immediately?
I have received only a softcopy of single page word document stating We are pleased to offer you the position and you can join us from 1st June. And after 2 months i have received Appointment letter, and it was written Please confirm that the above term & condition are acceptable to you and you accept the appointmnet letter by signing a copy of this letter. But i have not signed the copy yet. Now due to some health issues i want to resign. Can they take legal action ??

Please mention in your resignation letter that the company has not discussed anything about the terms and conditions and till now you have not given any terms and conditions either in writing or in verbal. Hence you cannot accept your appointment letter. Further you can ask them to settle the salary dues for the period you have worked and request them to releave you from the company, otherwise you will have to approach the court of law to get justice.
Better you contact a good lawyer, who can guide you in this.
You will have to serve notice period of two months as your terms and conditions of appointment will be governed by appointment letter as it is a contract. Even you have not signed appointment letter it does not make any difference as you have taken the benefits it is deemed acceptance.
