M. Alex (32) of Tiruchi, Safety Officer and N. Rajanarayanan (43), Operation Manager were held.- AUG 17, 2012- The Hindu - The arrest of Safety officer, occupier by State Police in case of a fatal accident- Is it Legal?

It is the Employer who has to take care of the employees Welfare, Safety, Hygiene and environment in that work area. In case if the employer fails to give adequate safety, then obviously the employer can be arrested. The employer has deployed the Safety Officer and Operation Manager for taking care of the safe working conditions of the employee. The safety officer is responsible for any Unsafe Act and Unsafe Conditions. He has to foresee the scenario and proactively handle the situation.

But if the Fatal accident is due to negligence of the workman himself then a case will be filed under CrPC-174 and the case will be closed after due investigation. If the relatives of the deceased filed any case then the concerned PS will enquire into the circumstances under which such accident took place and dispose of the case as per the findings.
