i worked from jan\'12 to May\'12 under contract at CMC,hyderabad and resigned. they paid upto april\'12 salary.
i have given one month notice and and worked up to last working day and left and they had given a last day formal submission letter, but after may-25-2012 to till oct-25-2012 not paid notice period salary [that is may month, monthly allowances jan -may\'12 and PF not yet paid as final settlement)
and even Release letter also.
irequested HR, manageing diretor through mails and called hyderabad hr.
almost 5 months over.
they are saying it takes time we are re-checking your
i request you how should i proceed now onwards.
i request you, please guide me , suggest me legal advice.


Nothing to worry as far as you have the Agreement with you and the proof of working in those months....

Secondly, it depends on the Amount to be paid to you, if it's a huge amount they may take few months for clearance, unless the specific period is clearance the maximum reasonable periods may be considered upto 6 months depending on the amount.

If the agreement is silent about the clause regarding default of payment, you need to send them a show cause notice through a registered post to a proper address, (keep the acknowledgement of registered post), the notice shall contain the facts regarding the agreement and fulfillment f the contract, and their failure to pay the amount, and giving them the last date before which they shall clear the F&f settlement formalities otherwise they shall have to face the legal consequences.....

By sending them the Notice you shall get a reply from them, accordingly if the reply is positive the issue ends there and you shall be concentrating on collecting the default amount, if the reply is negative you shall have to approach the court.....

Noticed may be served by yourself with the clear words having no ambiguities on the purpose for sending the notice.......
