I had worked with solutions Digitas since 1 Dec, 2010 to 4 Oct,2012. During this period starting since 1 Dec,2010 to 31 May, 2012 i was on the payroll of the Genius consultant, okhla, N. Delhi, After this since 1 June, 2012 to till my last day as 4 oct, 2012 I was on the pay roll of Digitas.

The company started the "Yearly Performance Bonus" from 2011 and first it was given in Feb 2012 for the last completed portion of 12 months till Dec 2011(it was divided in 2 parts, half part of 8 months and rest half for 4 months. but first time one time for all those who had completed 12 months).

Since starting 1 Jan 2012 to 31 Aug,2012 I have completed 8 months with the company and fulfilled all criteria. I have resigned from company on 5 Sep,2012 and started serving notice period of 30 days.

While i asked for the my half part of bonus they(HR) told me that you are not eligible to get paid to half portion of 16000 Rs. as you are resigned at the time of pay out as per co. policy).

But I have completed the 8 months with the co. for which i am eligible to get pay for bonus of 16000 Rs. So please advise me that how i can get this bonus.

Well, you shall need to go through the company policy carefully, secondly, if it says the employee will not be eligible for bonus in case of discontinuation of employment then you may have to observe, the discontinuation is whether during the bonus calculation period or even it included after the bonus calculation period, if it says, even after the period then you have no claims for bonus,

but if it is silent about leaving the company after the period and it only says that the employee is eligible upon the completion then you have clear claims on bonus.....

Thirdly, if you are sure that you have claims on bonus, as per the above clarifications, you shall make this point aware to the company and tell them that you are eligible, if they do not respond then you shall send a show notice claiming your amount through a registered post, it may be written by yourself, as far as the content is clear it is fine......
