QUERIES
I was working at Tech Mahindra,Sector 64, Noida. I had to go through lot of harassment, religious descrimination at work. Finally when it was unbearable, I escalated to HR directly via email because I knew managers and senior manager was not going to do anything about it. Over the email HR asked manager to take necessary action and manager assured that a meeting will be done with the people who were involved but that never happenend and the harassment increased. I was top performer and client was happy with me, finally I decided to leave and dropped and email to manager that I can serve only notice of 36 days instead of 2 months but my manager rejected it straight forward, till that time the harassment was increased upto the level I was not feeling safe anynmore and culprits were planning to physically hurt me, I was under so much mental stress and depression. I naratted the same to the manager Sushil Kumar Pandita but he didn't care about anything and stuck on one sentance that I have to service a complete notice period of 2 months. I sent him many emails that I will not be able to serve the notice period of 2 months. I put down my papers on 26th November and last was 31st of December as I had already told him. I didn't go to the office after 31st December. I got call from manager but I didn't pick up, got emails from HR and I replied to the 3rd email of HR and told them that I am ready to come to the office and settle the things. I submitted my ID card after few days (the only company property I had) and paid the amount of rs 3,250 which they asked me to pay to settle the things but later I recieved only service letter from their side with reason of leaving written as "absconding". I had told my new employer already that there is dispute with the previous company and I might not be able to provide the relieving letter and they agreed. I have been chasing HR's and sent many emails as well asking for the relieving and rest of the documents and have sent registered letters as well to top VP HR and directors in which I have mentionend all the harassment I had to go through but havn't recieved any reply. When I called the HR and asked why I am not getting all the letters whereas I had to leave the company due to the reason no action was taken against the people who were involved in harassment, he clearly said "we will not provide anything else and it will remain absconding". I need some guidance here, how should I move forward. I need the relieving letters, PF amount and salary of one month (if possible). If I go for the interview in MNC's, they might reject me even if I clear the interview on the basis of service certificate I got from Tech M which has absconding written on it. Please guide.

This is regarding Tanya's issue. I concur with Tanmoy Banerjee. In our country unfortunately we cannot go through the litigation even if we have clear cut rights and remedies just because of too much procrastination. We should reconcile with the situations and find out such a solution which would give us peace of mind. If the new employer is kind enough not to insist on relieving letter, Tanya should immediately join and continue to correspond with the earlier employer for relieving letter stating how unreasonable they are in withholding it. Many times it may work to escalate the issue up to CEO level rather than just limiting upto HR level
