Dear All! Recently a hired tractor met with an accident. The tractor owner claims that I have to repair the tractor. Is their any legal validity in his claim?
From India, Kolkata
The tractor which we engaged on hire basis, recently met with an accident. The tractor driver was seriously injured . We admitted him in the Government hospital and still the treatment is going on. The tractor owner never came to the hospital to meet the driver just to avoid the medical expenses.

On humanitarian ground, we are spending all the money. The local police has not registered a case against the tractor owner yet. We have also not registered a complaint with the police. Because the accident happened after completing our work while coming back and due to mechanical fault or negligence of driver.

Now the tractor owner claims that the company has to pay the hire charges for the accident period and as well as repairing charges. Being a local person he is having some influence in police station also it seems.

Please advice what I should do now.
