Worked for pvt ltd co. and resigned from after serving 15 years. Company is already settled all my dues soon after my resignation. (Gratuity thru commissioner)
During the employment i have earned insurance commission without knowledge of company doing agency for own company. These Observations are made later date and wants to sue me now. Please tell me it will be in labour court or Civil court. And on what ground my company can challenge & take legal actions. Is that sustainable in the court of law, any time frame and how to protect me. All observations are happened due to change of management.

The case would be deemed to be of a civil nature. Sustainability would depend largely on the Terms of your service. Also, if there was a clash of interest between the nature of your Job and that of the Agency you ran. Difficult to provide a prima facie opinion.
