I am teaching in a school. The school deducts security deposit of Rs 1000/ per month from my salary. The same has been reflected in my pay slip. Now I have to leave my job as I have to relocate due to my husband\'s posting.The school is refusing to refund security deposit of 5 months i.e. Rs 5000/-. My basic salary is Rs 5200/-and other allowances are Rs 4300/- making total emoluments Rs 9500/-. the school is deducting PF(12%) and ESI(1.75%). Is retention of security deposit legal? If not please advice action to be taken for claiming the security deposit. I am leavingthe job by end of this month.

Dear Sbats
What are the terms and conditions given in your offer letter / appointment letter. Have the school management mentioned about the security deposit in it. If the same is mentioned, they might have given as returnable deposit or non returnable deposit and some specific period. The PF and ESI Deduction are statutory deduction and you cannot challenge. But the security deposit can be challenged as per the terms and conditions given your appointment letter.
