Two separate issues.
First Suspension pending domestic enquiry. If it is proved the charges against him is true, then comes termination.
Now my question to all seniors:
If the charge sheet issued without the sanction of law.
If nothing is mentioned in contract of employment regarding the action taken by the management in case of disciplinary action
If domestic enquiry conducted without giving any chance to natural justice
If the termination based without the sanction of law
Labor Tribunal rejected my case due to my absence as I was not present due to my family problems.
Applied to Shops & Establishment Govt of west bengal who an order stating their limitation and requested to agitate in some other forum.
Now the case is in High Court - Kolkata where the opposition gave a point on Maintainability on law.
Where to appeal for my justified claim of reinstatement in service with all back wages.
Can anyone suggest me some remedies.
