I am working in a Limited co from past 5 years,HR instructed me over phone on 25th Aug that this month is my last as per the direction of management and force me to give the resignation letter but in the mean time boss is out of station and when he come on 11th Sept and I discussed with him he tell me the same thing and held up my salary and told it will released with full and final settlement in such situation I force to sent the resignation on dt 12th Sept and the same has been excepted immediately with a note you are released from 31st August so sir my question is how can they release me before the date of resignation.
further they have given me the gratuity for 1 yrs only while worked at 5 yrs I have completed the full and final settlement papers because my salary was held up and taken the amount by cheque as per there calculation but when I am asking the breakup they are not giving now sir please guide me the legal criteria how can i proceed further.
