Dear Contributing members,
I was worked with one of the Ltd. company for more than 9 years & they have given me termination letter due to some misconduct which was totally wrong. I have logged a complaint in labour commissioner office in Mumbai but they have informed the labour officer that he was appointed as a manager of the company & don't come in this jurisdiction. They have hold up my 7-8 lacs rupees full & final & deducted 5 lacs for store shortage & in termination letter they have mentioned they will give 2 lacs but still they have not cleared that amount & not responding my mails. Sir / Mam, Kindly advice some alternate way to get my dues because currently I m not in a position to file a case in civil court due to my financial condition & future career.
They have issued me a suspension letter in july'13 & termination letter in Mar’14 & still not clear my dues. I hope you will understand my situation because i am at home since july'13 without pay.

Mr. Ravi, What u said the statement is not clearly. r u doing the job after suspension? When complaint is logged? on which reason company give the termination letter?

Hi, company had given me a suspension letter in the month of July'13 & issued me a termination letter in the month of Mar'14. From July'13 till Mar'14 i was suspended & not doing job (as instructed by company not to report). Complaint logged in the month of March'14 & 2 hearing also conducted in Bandra labour office.
Suspension letter : Recruited Fake candidates. Shortages in the store where fake candidates working.
Termination Letter : they have found me guilty for the suspension letter reasons.
All the reason mentioned on my suspension letter was totally false. i have proper document to prove the same. They have not conducted any internal enquiry & not even given me a chance to defend. As per the termination letter they suppose to clear my pending dues (including gratuity) but they are not cleared any single amount.

For the Gratuity Part you can approach the concerned Labour Commissioner office who is the licencing / Registering authoriy of your establishment.
For other salary part and F&F Settlement Part you have to file a Civil Suit in the concerned court having the jurisdiction.

stick to the labour court case and also start to clear your PF and Gratuity dues from the concerned department.
u will definitely get justice if u r right.

I WAS WORKING IN LTD COMPANY AND WAS RELIEVED ON MAY 30 AND MY 24000 IS STUCK IN THAT COMPANY i.e MY 1 YEAR PERFORMANCE INCENTIVES AND MEDICAL AND LTA AND WHENEVER I CALL TO MY HR HE SAYS DIFFERENT FAKE REASONS LIKE U WILL GET JUST WAIT,AND HE SAYS COMPANY HAS NO FUNDS ETC...SOMETIMES HE DISCONNECTS PHONE ON MY FACE.IT HAS BEEN MONTHS I HAVE NOT GOT THAT MONEY.
KINDLY ASSIST WHAT TYPE OF CASE I SHOULD FILE AND WHATS THE PROCEDURE AND WHAT SHOULD I DO

Mr. Sashibhushan, you can recover the amount by filing recovery suit in the civil court but before that you need to send legal notice to your employer.
