Is it necessary to deduct ESI/EPF on Notice Pay?
From India , Madras
I think what Dr. KSN saying is right and clear.
In case of termination/abrupt ending of the employement no ESI/PF deductions are to be made-and notice pay-(as agreed by the employee and employer)
In case the employee gives proper notice-ESI/PF deductions are to be made normally.

Hi
My doubt is according to the Act PF should be deducted on payable salary , Interim advance and settlement benefit forms part of basic
wages and are liable for payment of provident fund contribution and other dues under the Act.Considering the legal implications and aftereffects it is better to deduct both.

Simple logic is, whether the person is still the employee of the company and gets the salary during the notice period or not?? if yes and then yes everything applies as usual........
and regarding your last, the last payment of the employee will still be considered as salary......... the only difference being the changes in the amount paid.......
