Hello All ,

I have resigned from Tech Mahindra on 22nd May 2017 with willingness to serve notice period of 90 days but organisation relieved me in just one day notice i.e. 23rd May 2017. I have never requested to release me early because I don't have any other immediate offer letter in hand. As per company policy Either party can terminate the employment by serving a notice of 90 days on the other and basic pay of notice period will be done to either party if notice period is not served.

When I have tried to clarify from HR , they said that as per the policy , Company may at its absolute discretion make a payment representing salary (basic) in lieu of notice of termination. And HR have denied to pay any notice period pay to me.

I need your suggestion that can I proceed with legal notice to company as company should pay notice period pay to me as per the policy . Please suggest.
