I have worked with one private company in Mumbai for two years, before leaving company i have served one month notice period as per company appointment letter and my full and final settlement was due after 45 days from my last working day.
Its been 5 month i have not received my full and final amount however after n number of emails and followup they have released my experience letter but settlement amount is still due.
I have approached every respective department in company like HR, Finance, Branch Head (Whom i was reporting) and finally CEO but no reply received, I have all the proofs in email/ whatsapp that they have promised to release my Full and Final settlement but now no one is responding.
Finally I have send legal notice through my advocate to branch head and CEO of the company, Branch head (In Mumbai) have received my legal notice however after knowing this now CEO (Sits in Delhi) is refusing my legal notice. This is not the first time company is doing they have been doing this with many employee and stakeholders in past.
Respective panelist please suggest what should I do now ? can I file a case against them on the basis of receipt of my first communication to Mumbai branch head or should I send them notice again. Can I file FIR against them at local police station? What if they wont appear in court after filing a case?
please advise.
