As per Payment of Bonus Act , The defination of Employee" means any person (other than an apprentice) employed on a salary or wage not exceeding [(Note: Subs. by Act No.67 of 1985, Sec.2, for the words "one thousand and six hundred rupees" (w.e.f. 7th November, (1985)) two thousand and five hundred rupees] per mensem in any industry to do any skilled or unskilled manual, supervisory, managerial, administrative, technical or clerical work for hire or reward, whether the terms of employment be express or implied; Now this limit is revised up to 3500/- ,
In our co. All employees are drawing salary above Rs. 3500/- so whethere they are entitled for the bonus or not ?

Dear Sir,
I m Tanuja Naik and would address one case of our own company, where the bonus amount of 10% is deducted from our monthly salary. For eg.
Employee XYZ Salary Breakup
Component Amount
Basic 7619
HRA 20% 1524
Conveyance Allowanc 20% 1524
Medical Allowance 20 % 1524
Educational Allowance 20% 1524
LTA 20 % 1524
Short term benefit (Bonus @ 10% PM) 762
16000 pm
Now they deduct bonus amount from each one personal monthly salary is this is the right calculation of deduction?
Kindly help , I think PF consultant is exploiting with the employees salary breakup, kindly help.
