If an employee avails leave without permission, it will be treated as 'absent' and employer can initiate suitable action (which includes 'termination' of his services) after giving due notice to the employee. If the appointment letter contains a clause pertaining to this type of absentism, employer can terminate the services if no reply is received from the employee even after seeking explanation for such absentism.,

29th October 2013

Dear Sir
I would like to take help on the same topic that if Boss refuse to grant the leave and we will take it then it will treat "absent" but in our appointment letter there is mention that employer will give SL ,CL and EL . We are taking equally as mention in appointment letter . Can employer can terminate us in such case ? Can we challenge in such case ?
Please suggest me .
