Hi Frnds, I'm an emp of one MNC working as a Sr.Software Engineer. My joining date was Nov 2nd & i was in probation for 6 months as specified in my offer letter. Regarding notice period, its specified as "Your services are terminable with one month’s notice on either side."

Now the company changed the Notice Period to 2 months during this year appraisal. So who all got appraisal this year, they signed the paper which states 2 months notice period from April'10.

On April 30th, I have kept my papers, but HR is saying that I also have to serve 2 months notice period. But I havent signed any paper or I havent got any information from HR about the change in notice period.

Even I havent got my confirmation, before I placed my papers. No papers, no information, no notification, nothing from HR side, but they want me to serve 2 months. I have some personal commitments & I have to relive by May 31st.

Internally from my Team Manager I came to know that there's a lack of resource & even they are not willing to recruit any new resource. So they want me to stay till June 30th, becoz from another team one person is getting released from his current project. So they will transfer him to my team.

Please let me know is there any way i can get rid out of the 2 month notice period.

My opinion is as hereunder:
Your probation started from 2nd November and as per the terms of your, you are on probation on 30th April. Further you have stated that there was no communication from the HR department for the changes in the terms. Did you get any increase in salary effective 1st April and if the answer is 'yes', was there any letter informing you of this increase and any changes in the terms. If your answer is 'no', you have to give only one month notice and the company has to relieve you on or before 31st May.

Employment is a contract and your appointment letter is itself a valid document. You can quote that and request the company to relieve you within the time you have stipulated. Further, it is always better to part smoothly and hence deal with the matter politely and tactfully.

I already had a very polite meetings with my PM & HR Manager, but they are forcing me to serve 2 months. As my TL suggested, PM wont relive any resources within 1 months, but 1 guy, filed a case against our company; then they silently relived him without any issue. So my TL suggesting me to go legally, otherwise its not possible.
Even I don't want to spoil the friendly atmosphere which I was having now, but my PM was very adamant, that he sticks to his plan only.

As per my knowledge if you are quiting within your probation period and as per your appointment letter the notice period is 1 month and further management is increasing that notice period for 2 month effective from 1 may. hence you not coming within that frame hence 2 months notice period is not applicable on you and more over no intimation of increase in notice period informed to you hence you are not aware of any change.
Answer my 2 -3 questions : If your resignation has accepted or not ?
2. resignation handed over to PM or HR Manager in which form i.e hard copy or soft copy ?
3. any receiving has been obtained or not ?
If every thing happens with a gud atmosphere and gesture that's gud other wise simply go to labour office and hand over a hard copy of your complaint to concerned labour inspector that they people are not clearing my dues.

Here i have provided the ans for ur ques... pl help me :)
1.If your resignation has accepted or not ? - Accepted & asked me to serve for 2 months notice period, i.e. till June.
2. resignation handed over to PM or HR Manager in which form i.e hard copy or soft copy ? - PM in soft copy, but had a word with HR manager also, regarding the non-intimation of 2 months notice period.He's saying policy is applicable for all the employess irrespecitive of their status.
3. any receiving has been obtained or not ? - Received an acknowledgement for my PM with the last working day details in soft copy i.e. in E-mail
Note : Notice Period change is effective from April 1st. But there was no information passed earlier.

Please write a letter to the company quoting the terms of your original appointment order, your resignation letter submission and request for relieving end May, non-receipt of any communications from the company for extension of notice period and finally state that your last date is 31st May and you will not be attending the office thereafter. Submit this personally, take an acknowledgment, send another copy by 'Speed Post' with acknowledgment and also mark a copy to your PM (since the original will be addressed to HR, ).
Please take care to get your PF transferred though this will be a small amount. This can be done later either on joining the new company through them or after the lapse of the statutory period (60 days if I am correct)
