hi,i want to ask about the legal status of the owner of flat,if the building is destroyed due to the passage of time.

See, in any apartment or multistoried building, all resptive owners of different flats have proportional ownership rights over land on which that apartment or building is constructed and the proportion of ownership is decided as per individual's flats space/area to the total space/area of whole building with regard to plot/land area. If building is destructed due to any reason, then all respective owners of different flats will be having joint ownership over land as already said hereinbefore.

A house is booked on 27th May 2012,

Registered in Nov 2012.

As per agreement the building should be handed over to us within one year, can extend 3 months due to so many reasons

The house is handed over in 12 2016 Feb..

1. As per agreement the builder should have paid the VLT (vacant land tax) till the handing over of project.

This is not yet paid, said that this will be paid along with other buildings.

As of now the VLT is not paid

2. For additional amenities such as parks, school, shopping, gym,. swimming pool, play ground should be constructed by builder,

taken 40 paise/sq feet. Name sake he has started for a park construction since July 2016, nothing completed, when it is asked they say we have responsibility this will be done.. time frame they are providing.

3. As a gated community this is promised. Whereas there is not even a gate, only compound wall is constructed Three places there are opening, a security is placed for their property, there is no control on the campus, what should we do

4. The entire village people use the road which is constructed. The road is constructed by municipality

5. A association is formed by initial entrants and this is maintained, and no accounts or documents are maintained, unable to reach through association too.
